Terms of Service
These Terms govern your use of the AI From U API and customer portal (the “Service”). The Service is operated by AI From U, of TNR Building, 180 Nguyen Cong Tru Street, District 1, Ho Chi Minh City, Vietnam (“we”, “us”), the party you contract with. By purchasing a plan or using the Service you accept these Terms. If you do not accept them, do not use the Service.
1. What the Service is
The Service provides access to third-party large language models through an interface compatible with the OpenAI API format, under the model names sol, terra and luna. We are an independent service. We are not affiliated with, endorsed by, sponsored by, or authorized by OpenAI. OpenAI provides the underlying models; we manage access, quota, usage reporting and billing.
2. Accounts and API keys
You must provide accurate registration details and be legally able to enter into this agreement. Your API key is shown once and is your responsibility: you are liable for all usage made with it, whether or not you authorised that usage. Rotate it immediately in the portal if you believe it is exposed. We are not liable for loss arising from a key you disclosed, stored insecurely, or embedded in client-side code.
3. Credits, quota and how billing works
Each plan grants a fixed number of AI credits for a 30-day period. Credits are a unit of quota, not money, not a currency, and not a stored-value instrument. They have no cash value, cannot be transferred, sold or exchanged, and cannot be redeemed for cash.
Each request consumes credits according to the published per-model conversion rates. Rates differ by model and by token category, including cached input, cache writes, reasoning output and long-context requests. We publish the current rates on our website and in your portal.
Unused credits expire at the end of each 30-day period and do not roll over. When your balance reaches zero, new requests are refused until the next period begins or you upgrade. We do not charge usage-based overage fees.
4. Fees, renewal and cancellation
Plans are prepaid and renew automatically every 30 days until cancelled. Purchases are made from Polar (polar.sh), our merchant of record and the seller of record for the transaction: Polar processes your payment, issues your invoice or receipt, collects any applicable taxes and handles refunds under its own terms, which you also accept by purchasing. AI From U provides the Service; we never receive or store your full card details.
You may cancel at any time through the billing portal. Cancellation takes effect at the end of the current paid period; your plan remains usable until then. We do not pro-rate or refund a partial period.
5. Refunds
Because credits are delivered immediately on payment and are consumed as you use them, fees are non-refundable, including for credits you did not use before the period ended. This does not affect rights you have under mandatory consumer law in your jurisdiction that cannot be waived by agreement. If you believe you were charged in error, contact us within 30 days at support@aifromu.com and we will investigate.
6. Acceptable use
You must not use the Service to: break any applicable law; generate or distribute child sexual abuse material, unlawful sexual content, or content that harasses, defames or incites violence; infringe intellectual property or privacy rights; develop weapons, malware or tools intended to cause harm; misrepresent AI-generated output as human-authored where doing so is deceptive; or attempt to bypass quota accounting, rate limits or authentication.
You must not resell, sublicense or provide the Service to third parties as your own API, or share a single plan across separate organisations, without a written agreement with us.
Your use must also comply with the usage policies of the underlying model provider, because your requests are served through it. A breach of their policies is a breach of these Terms.
7. Availability
The Service is provided on a best-effort basis. We do not commit to any uptime level, latency, throughput or service-level agreement. We may perform maintenance, impose rate limits, or restrict capacity at any time. Capacity depends on upstream provider limits that we do not control and that are shared between customers.
8. Changes to models, rates and these Terms
We may change which upstream model a name maps to, adjust conversion rates, or change plan pricing. For changes that increase your cost or materially reduce what a plan provides, we will give at least 30 days’ notice by email, and the change applies from your next renewal. Continuing to use the Service after that date is acceptance. We may change these Terms in the same way; the current version is always published here.
9. Suspension and termination
We may suspend or terminate your access immediately and without refund if you breach these Terms, if we reasonably suspect fraud, abuse or activity that threatens the Service or other customers, or if required by law or by our upstream providers. We may also discontinue the Service entirely on 30 days’ notice, in which case we will refund the unused portion of your current period.
10. Your content and our rights
You retain all rights in the content you send and receive. You grant us only the licence needed to transmit it to the upstream provider and return the result. We do not store your prompts or completions (see the Privacy Policy). We retain all rights in the Service itself, including its software, documentation and branding.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. Model output may be wrong, offensive or misleading. Do not rely on it for medical, legal, financial or safety-critical decisions without qualified human review. You are responsible for evaluating output before acting on it.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, however caused. Our total aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the three months immediately before the event giving rise to the claim. Some jurisdictions do not allow these limits, in which case they apply to the fullest extent permitted.
13. Indemnity
You will indemnify and hold us harmless against claims, damages and reasonable legal costs arising from your use of the Service, your content, or your breach of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Any dispute will be resolved by the competent courts of Vietnam, and you consent to their jurisdiction. Each party waives any right to a jury trial and to participate in a class or representative action, to the extent permitted by applicable law.
15. General
If any provision is unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets. These Terms are the entire agreement between us about the Service.
